I wont touch the system until they link my games to my account. I lost a 3DS and had to go through a painful process to retrieve my digital content. Not only that, but what happens to my content when they shut down the servers. Gone forever. Degrading my ability to enjoy the content i spend my well earned money on. I will stick to my 3DS where I can at least enjoy the games i've purchased in a physical format if this is true.

I'd also like to mention future BC when using carts. You can still use first gen, low speed SD cards in today's card readers. As long as Nintendo keeps using the same interface, or interfaces that progressively improve (like USB 1.0 through 3.0), your Nintendo system that comes out in 20 years could still play the NX carts you're buying as early as next year. Of course, this assumes the NX platform will persist that long, but you can still technically play Windows 95 games 20 years later.

I think the biggest concern would be API calls being deprecated. Applications written for older versions might not run correctly if those features are no longer present so those would need to be bridged at the operating system or virtual machine level.

NX isn't a replacement for the Wii U as Nintendo stated that they will be loyal to the Wii U customers and continue to support software. Think of the NX as a 'gradual' replacement rather than an immediate.
