<p>There was a bitter battle earlier between Motorola and Microsoft where heavy compensation was demanded by Motorola for the Xbox 360 infringing on some of its patents. However, according to a latest report by <a href="http://www.computerandvideogames.com/385852/google-ends-one-patent-war-with-microsoft-over-xbox-360/">CVG</a>, it seems Motorola has dropped that patent.</p>
<p>It&#8217;s not easy to dominate Microsoft that way especially because Xbox 360 is one of their major products and they will not take it lightly, but it looks like the entire matter was thrown out by the judge.</p>
<p>Judge James Robart said that the ability to take the Xbox 360 online and to play video were Frand innovations necessary to all consoles to allow them to meet consumer expectations, and therefore no monopoly was possible.</p>
<p>Microsoft hit back at Motorola earlier by going after their phones, like any company under fire would but it&#8217;s not clear what went down with that.</p>

Judge Shaw also recommended that, &#8220;the commission prevent sale of the consoles with a cease-and-desist order, and that Microsoft post a bond equal to 7 percent of the declared value of unsold Xbox inventory already in the country,&#8221; wrote Courthouse News Service.</p>
<p style="text-align: justify">&#8220;Microsoft argued that Shaw&#8217;s exclusion order does not serve the public interest because it would leave consumers of video game consoles with only two options to satisfy their needs: the Sony Playstation and the Nintendo Wii.</p>
<p style="text-align: justify">&#8220;Shaw rejected that argument, finding that the public interest in enforcing intellectual property rights outweighs any potential economic impact on video game console buyers. Moreover, he said, Microsoft did not even try to show that its competitors were incapable of meeting demand for the consoles.&#8221;</p>

<p>A patent dispute between Microsoft and Motorola has resulted in an injunction banning several Microsoft products from distribution in Germany, including Xbox 360.</p>
<p>This ban also extends to the distribution of Windows 7, Internet Explorer and Windows Media Player in the country.</p>
<p>The development follows last week&#8217;s news that the duo were locked in a legal battle in the US courts.</p>
<p>The disagreement stems over Microsoft’s use of H.264 video compression technology.</p>
<p>Microsoft seemed to anticipate this ruling, however, and  moved its European distribution centre from Germany to Holland last month.</p>
<p>&#8220;This is one step in a long process, and we are confident that Motorola will eventually be held to its promise to make its standard essential patents available on fair and reasonable terms for the benefit of consumers who enjoy video on the web,&#8221; said a Microsoft spokesperson</p>
<p>&#8220;Motorola is prohibited from acting on today&#8217;s decision, and our business in Germany will continue as usual while we appeal this decision and pursue the fundamental issue of Motorola&#8217;s broken promise.”</p>
<p>A eventual agreement between the companies seems likely, however, with Motorola facing very high legal costs if it wishes to maintain its injunctions.</p>
