<p>Looks like The Last Guardian is still alive and well and was recently spotted at a Portuguese retail store. The discovery of The Last Guardian life-state was posted via <a href="http://www.neogaf.com/forum/showthread.php?t=576049">NeoGaf</a> by a forum user named Takuya; however, the original report was found by  MetalMurphy.</p>
<p>The Last Guardian was missing for the last few years without any evidence of the existence. With PlayStation 4 on the horizon,  many rumors pointed towards that the long-missing title went to either PlayStation 4, stayed on PlayStation 3 or will be a cross-gen release.</p>

<p>The version of the game that is up for pre-order in the Portuguese retail store is for the PlayStation 3; however, this does not mean that the PlayStation 4 one doesn&#8217;t exist, and there is still hope for a cross-gen possibility. Overall, it&#8217;s gratifying to see physical proof of the game&#8217;s existence in some shape or form.</p>
<p>We&#8217;re close to E3 2013, and it&#8217;s safe to say the game will be officially unveiled for the PlayStation 3 or as a cross-gen release for next and current gen Sony platforms.</p>

<p>&#8220;That being 3 years from the USPTO issuing &#8220;Notice of Allowance.&#8221; NoA = there not being any conflicts with other marks and other requirements. The NoA for the Last Guardian mark was actually issued in Jan. 2010, which would give a limit to Jan. 2013 to prove use in commerce.</p>
<p>&#8220;&#8216;Use in commerce&#8217; meaning Sony has to prove they released the game, which I guess they realized wasn&#8217;t going to happen by January. There is, however, nothing stopping Sony from filing a new trademark registration for The Last Guardian, which I imagine they will do.</p>
<p>&#8220;As the [<a href="http://tdr.uspto.gov/jsp/DocumentViewPage.jsp?77750563/NOA20120806223349/Notice%20of%20Abandonment/1/06-Aug-2012/sn/false#p=1" target="_blank">Notice of Abandonment</a>] says, they can still send a petition to the USPTO to revive or request the mark, though the three year rule still applies.&#8221;</p>
<p>TL;DR &#8211; the Notice of Abandonment isn&#8217;t quite as dire as it first seemed and Sony effective have until January 2013 to file an extension and prove &#8216;commercial use&#8217;, which is as simple as referring to the E3 tech demo.</p>
<p>To further alleviate any fears of canned-Ico, <a href="https://twitter.com/kobunheat/status/233679576159617024" target="_blank">Sony sent a statement to Wired</a> earlier this evening confirming the game is still in development.</p>
