Remember the disastrous Battlefield 4 launch? I mean, if you think the launch of DriveClub was bad, you weren’t there around last year when Battlefield 4 launched. Either that, or you have a very short memory.
Anyway, the launch was so bad that some folks figured they would start a lawsuit against EA over it. Said people being, you know, EA shareholders, who felt that EA had misrepresented the game to shareholders (as well as to everyone else involved).
But on Monday, a federal judge ruled against the shareholders. According to the judge, any misrepresentation by EA was not deliberate, that “the complaint fails to adequately allege falsity and scienter for reasons articulated by defendants.”
So what this means is that the lawsuit cannot proceed by these two people for financial and securities fraud, although the judge did say she will allow other lead plaintiffs to come forward if they wish to make a case and pursue damages.
Personally, I think we should just ditch the financial mumbo jumbo and just start a class action lawsuit for false advertising.
Or, you know, we could just let it go. The game (mostly) works now.
