US District Judge Anthony Battaglia has dismissed several charges that were leveled at Sony with regard to last year’s PlayStation Network hack (Courthouse News). Charges of negligence, restitution and unjust enrichment have been dismissed.
Sony was also cleared of violations of consumer protection laws in California “because none of the named plaintiffs subscribed to premium PSN services, and thus received the PSN services free of cost.”
A bailment charge was also dismissed- “plaintiffs freely admit, plaintiffs’ personal information was stolen as a result of a criminal intrusion of Sony’s Network. Plaintiffs do not allege that Sony was in any way involved with the Data Breach.”
Sony was also accused of falsely advertising their system’s security. Battaglia dismissed those charges too, citing PSN’s Privacy Policy that had “clear admonitory language that Sony’s security was not ‘perfect,'” therefore “no reasonable consumer could have been deceived.”
