Nintendo has to pay $30. 2 million due to infringing on a patent pertaining to the 3DS’ glasses free 3D tech. The patent belongs to an ex-Sony employee Seijiro Tomita.

Tomita had challenged Nintendo in 2011 and according to a new statement released by the company via Kotaku, it had plans to buy the technology and was in talks with various inventors.

The company will appeal the decision it has been revealed.

“Nintendo is confident that the result will be set aside. The jury’s verdict will not impact Nintendo’s continued sales in the United States of its highly acclaimed line of video game hardware, software and accessories, including the Nintendo 3DS. Nintendo has a long history of developing innovative products while respecting the intellectual property rights of others.”

The case could be in Nintendo’s favour but it seems the federal jury have decided that the company has indeed infringed on the patent.
